Permission to edit Document Type items but remove access to create new item

Hi,
I set the "Admin" user group to edit "Article" document type but I need to remove its access to "create new item" on that type. Whenever I disabled "Create items" in "Article" type and go to edit page, it won't allow me to save because the document type is empty and requires me to choose other type. Is there any configuration that will set automatically the existing type and allow to edit freely without giving access to "add" item? What would be the workaround for this?

if i remember this was fixed, after v3.1.1
in v3.1.1 if a user cannot create a type then user will have the problem that you decribe

in v3.1.1 only way to do it is to use Category permissions instead ,

but note if you use category create/edit permssions it will effect all types
